By (a) accessing SpeedyDrone.ca or any sub-domain, (b) purchasing, renting, test-flying, servicing, or otherwise using any product or service supplied by SpeedyDrone Canada Inc. (“SpeedyDrone,” “we,” “us,” “our”), or (c) entering any of our retail premises, you (“Customer,” “Operator,” “Purchaser,” or “User”) agree to be bound by this Liability Disclaimer in its entirety.

If you do not accept these terms, do not use our site, visit our stores, or interact with our products or services.

2. Informational Content Only

All photographs, videos, blog posts, tutorials, manuals, FAQs, chat support, and other materials we provide are for general information only. They do not constitute legal, technical, aviation, insurance, or safety advice.

3. User Obligations

• Training & Competency: Operate UAVs only if you possess the requisite knowledge, skills, and Transport Canada Pilot Certificate.
• Regulatory Compliance: You must register applicable drones, respect flight-restriction zones, fly within visual line-of-sight, observe altitude limits, and comply with all federal, provincial, and municipal rules, including privacy statutes.
• Insurance: Maintain appropriate UAV liability insurance covering bodily injury, property damage, and any consequential loss arising from operation.
• Configuration & Maintenance: You are solely responsible for correct assembly, firmware updates, calibration, Wi-Fi/Bluetooth configuration, battery management, storage, and ongoing airworthiness of all equipment.

4. Inherent Risks & Assumption of Liability

Drone use entails hazards, including but not limited to collision, crash, fire, electric shock, data loss, personal injury, environmental harm, and third-party claims.

• Damage to the aircraft, accessories, or payload.
• Damage to real or personal property, wildlife, or livestock.
• Injury, including death, to yourself or any third party.
• All costs, fines, penalties, legal fees, and insurance deductibles stemming from your actions or omissions.

5. Repairs, Modifications & Third-Party Parts

When SpeedyDrone services or modifies your equipment:

• Risk of loss to the unit and onboard data remains yours.
• The use of non-OEM parts, aftermarket firmware, or performance modifications may void the manufacturer’s warranty and contravene regulations.
• We make no warranty, express or implied, regarding third-party parts or software, and disclaim liability for any resulting malfunction or loss.

6. Shipping, Delivery & Title

Title and risk of loss pass to you once goods are transferred to the carrier. We are not responsible for carrier delays, theft, damage, or customs holds.

7. Service Availability & Accuracy

We do not guarantee that our website, POS systems, network services, or in-store demos will be uninterrupted, timely, secure, or error-free. We may suspend or discontinue any service, product line, demo flight, or rental program at any time without notice.

Results obtained from using our site or services, including mapping data or firmware downloads, may be inaccurate or unreliable, and you accept all associated risks.

8. Disclaimer of Warranties

Except as expressly stated in a written manufacturer’s warranty supplied with a product:

• ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
• WE EXPRESSLY DISCLAIM all representations, warranties, and conditions, whether statutory, express, or implied, including but not limited to merchantability, merchantable quality, fitness for a particular purpose, durability, quiet enjoyment, title, and non-infringement.

To the fullest extent permitted by applicable law, SpeedyDrone Canada Inc., its directors, officers, employees, affiliates, agents, contractors, suppliers, and licensors shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, exemplary, or consequential damages of any kind.

• Your use or inability to use any product, service, or website function.
• Errors, omissions, or inaccuracies in any content.
• Delays, failures, or interruptions in service delivery.
• Third-party conduct, parts, firmware, or content.
• Any other matter connected to SpeedyDrone.

10. Indemnification

You agree to indemnify, defend, and hold harmless SpeedyDrone and its affiliates from any third-party claim, demand, loss, liability, damage, or expense, including reasonable legal fees, arising out of or related to:

• Your breach of this Liability Disclaimer or any applicable law.
• Your negligent or wrongful act or omission.
• Your misuse of our products, services, or intellectual property.

11. Privacy & Data Security

We collect, process, and store personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and our posted Privacy Policy.

12. Governing Law & Jurisdiction

This Liability Disclaimer and any dispute arising hereunder shall be governed exclusively by the laws of Canada and the Province of Ontario, without regard to conflict-of-law principles.

You irrevocably submit to the exclusive jurisdiction of the courts located in Toronto, Ontario.
